Winter Session, 2023 to begin from December 15.

In exercise of the provisions under Rule 33(4) of the Chakma Autonomous District Council (Constitution and Conduct of Business, etc.) Rules, 2002 and as amended from time to time, Dangu Kali Kumar Tongchangya, Chairman, Chakma Autonomous District Council is pleased to summon the Members of the 11th Chakma Autonomous District Council to sit for Winter Session, 2023 to be commenced from 15th December, 2023 (Friday) at 10:30 A.M. in the Session Hall of Chakma Autonomous District Council, Kamalanagar.

All Business both Official and Non-official meant for the Winter Session 2023 may be submitted to the undersigned during office hours on or before 1st December, 2023 (Friday).

CADC Chairman Dg. Kali Kumar Tongchangya disqualified following conviction

𝐊𝐚𝐦𝐚π₯𝐚𝐧𝐚𝐠𝐚𝐫, πŸπŸ– π’πžπ©π­πžπ¦π›πžπ«, πŸπŸŽπŸπŸ‘: Dg. Kali Kumar Tongchangya, the incumbent Chairman of the Chakma Autonomous District Council (CADC), has been disqualified from the membership of the Council with immediate effect. The disqualification follows his recent conviction on corruption charges in the Court of Special Judge, Prevention of Corruption Act, Mizoram, Aizawl, on 26th September, 2023.

In an official notification dated 27th September, 2023, issued by the District Council Secretariat of Chakma Autonomous District Council, the disqualification of Chairman Dg. Kali Kumar Tongchangya was announced after he was found guilty under Section 409 of the Indian Penal Code (IPC) and under Section 13(2) read with 13(1)(c) & (d) of the Prevention of Corruption Act, 1988. As a result, he has been sentenced to undergo four years of imprisonment along with a fine of Rs. 2 lakhs.

This disqualification action is in accordance with Clause (i) of Sub-rule (1) of Rule 12 of the Chakma Autonomous District Council (Constitution and Conduct of Business etc) Rules, 2002, and as amended. This rule stipulates that a member shall be disqualified if convicted of any offense other than those referred to in clause (f) & (g) and sentenced to imprisonment for not less than two years.

Dangu Sundor Muni Chakma, the Deputy Chairman of the Chakma Autonomous District Council, has exercised the powers provided under Sub-rule (1) of Rule 17 of the Chakma Autonomous District Council (Constitution and Conduct of Business etc) Rules, 2002, and as amended, to issue the disqualification order.

However, the notification states that, as per Sub-clause (j) of Sub-rule (1) of Rule 12 of the Chakma Autonomous District Council (Constitution and Conduct of Business etc.) Rules, 2002, and as amended, this disqualification will not take effect until three months have elapsed from the date of Dg. Kali Kumar Tongchangya’s conviction. If, within that period, an appeal or application for revision is preferred from the conviction or the sentence, and an interim stay against such conviction or suspension of such sentence has been obtained by him from a competent appellate or divisional court, then the disqualification will be put on hold until a final decision is reached.

CADC Monsoon Session prorogued

Kamalanagar, August 18, 2023: The Monsoon Session of the 11th Chakma Autonomous District Council (CADC) which started on 16th August, 2023, reached its conclusion today, August 18, 2023, after three sittings. A total of 21 members, including the 4 nominated members, participated in the final sitting.

During the concluding session today, a total of 5 questions have been transacted, of which Dg. Doymoy Daveng Chakma, Member of District Council (MDC), CADC, raised 2 unstarred questions and 1 starred question, while Dg. Nirupam Chakma, MDC, CADC, presented two unstarred questions.

Dg. Rasik Mohan Chakma, Chief Executive Member and house leader introduced 3 bills before the house for consideration, which were thoroughly discussed and deliberated upon by the members. Out of the three bills, the following two bills were passed unanimously:

  1. The Chakma Autonomous District Council (Constitution of Planning and Development Board) Rules, 2023
  2. The Chakma Autonomous District Council (Constitution of Law Board) Rules, 2023.

However, in the case of The Chakma Autonomous District Council (Town Committees) Act, 2023, diverse opinions emerged within the house. Consequently, the bill mover Dg. Rasik Mohan Chakma proposed that it be referred to a select committee for further examination which found unanimous agreement of the house.

With the successful completion of all scheduled business transactions, the Monsoon Session was prorogued.

Four Nominated MDCs of CADC Sworn-in

Kamalanagar, August 18, 2023: Four nominated members of the 11th Chakma Autonomous District Council namely Dg. Hemanta Larma of Borapansury-I, Dg. RD Sangzela of Damdep-II, Dgb. Chandrasusi Chakma of Udalthana-I and Dgb. Sona Chakma of Kamalanagar-III have been formally sworn in today, August 18, 2023. The oath-taking ceremony took place in the session hall of CADC, with the newly appointed members taking their solemn oath of affirmation before Dg. Inglon Chakma, Court President and Recorder.

With the addition of these four nominated members, the 11th Chakma Autonomous District Council now stands complete. Hon’ble Chairman of CADC, Dg. Kali Kumar Tongchangya, expressed his contentment at the completion of the council members and noted the positive stride taken towards women’s empowerment through the nomination of two women members.

House leader and Chief Executive Member, CADC, Dg. Rasik Mohan Chakma, extended his heartfelt congratulations to the newly appointed members. He expressed confidence in their ability to contribute valuable insights and perspectives on matters of justice, good governance, and overall development, both within the house and beyond.

Dg. Nirupam Chakma, MDC, and Dg. Doymoy Daveng Chakma, MDC, also took the floor during a motion of thanks, congratulating the nominated members on their new roles and expressing optimism about their active involvement in shaping the progress of CADC in various spheres.

Speaking on behalf of the nominated members, Dg. Hemanta Larma conveyed their gratitude to House leader and CEM, Dg. Rasik Mohan Chakma, for their appointment. He took a moment to honor the legacy of Dr. B. R. Ambedkar for the visionary provisions in the constitution that enable the participation of nominated members in the council. He expressed their commitment to contributing their utmost to the betterment of CADC.

Second sitting of CADC Monsoon Session held

Kamalanagar, August 17, 2023: The second sitting of the Monsoon Session of the 11th Chakma Autonomous District Council (CADC) was held on Thursday, the 17th of August, 2023, at the CADC Session Hall. The session was attended by 13 members.

During the Question Hour, a total of 9 out of 14 questions listed for transaction for the day were addressed. Dg. Nirupam Chakma, MDC, CADC, raised 5 unstarred questions. Dg. Doymoy Daveng Chakma, MDC, CADC, presented 3 unstarred questions and 1 starred question.

Three private member resolutions were brought before the house for consideration and voting. Dg. Doymoy Daveng Chakma, MDC, CADC, introduced a Private Member Resolution seeking the formation of committee for studying the long pending bills of CADC and to pursue them with the Government of Mizoram for early approval. The resolution garnered unanimous support and was hence passed.

Another private member resolutions brought in by Dg. Doymoy Daveng Chakma, MDC, CADC, pertaining to the formulation of proper guidelines for beneficiary selection under the Animal Husbandry and Veterinary Department and allied sectors received the support of 2 members, while 11 members opposed, resulting in its inability to carry.

Similarly, a private member resolution proposed by Dg. Nirupam Chakma, MDC, CADC, seeking the establishment of an autonomous body in the name of β€œCADC Recruitment Board” for the recruitment of staffs under the Chakma Autonomous District Council, encountered diverse perspectives. With 2 members supporting, 10 opposing, and 1 abstaining, the resolution did not secure the required majority to carry.

The session was adjourned for the day. The next sitting is scheduled for tomorrow, August 18, 2023.

First sitting of CADC Monsoon Session passes 3 Bills

Kamalanagar, August 16, 2023: The first sitting of the 11th Chakma Autonomous District Council’s Monsoon Session took place today, marked by the active participation of 18 council members. During the question hour of today’s session, a total of seven unstarred questions and two starred questions were addressed. Dg. Nirupam Chakma, MDC, CADC, raised five unstarred questions, while Dg. Doymoy Daveng Chakma, MDC, CADC, posed two unstarred and two starred questions.

Three important Amendment Bills were introduced by the Chief Executive Member and leader of the house. The Bills presented were: (1). The Chakma Autonomous District Council (Salaries and Allowances of Chief Executive Member and Executive Members) (Second Amendment) Bill, 2023. (2.) The Chakma Autonomous District Council (Salaries and Allowances of Chairman and Deputy Chairman) (Second Amendment Bill), 2023 and (3.) The Chakma Autonomous District Council (Salaries, Allowances and Pension of Members) (Third Amendment Bill), 2023.

The Chief Executive Member explained the rationale behind these proposed amendments, highlighting their necessity and benefits and sought the valuable opinions of the members and their support for the proposed Bills. All the three amendment bills were passed unanimously through a voice vote.

With the successful transaction of the day’s list of business, the session was adjourned. The upcoming sitting is scheduled for August 17, 2023.

CADC Monsoon Session 2023-24 to commence from 16th August 2023

In excercise of provisions under Rule 33(4) of the Chakma Autonomous District Council (Constitution and Conduct of Business etc.) Rules, 2002 and as amended from time to time Dangu Kali Kumar Tongchangya, Chairman, Chakma Autonomous District Council is pleased to summon the Members of the 11th Chakma Autonomous District Council to sit for Monsoon Session, 2023 to be commenced from 16th August 2023 (Wednesday) at 10:30 A.M. in the Session Hall of Chakma Autonomous District Council, Kamalanagar.

All Business both official and non-official meant for the Monsoon Session may be submitted to the office of the Chairman, CADC during office hours on or before 2nd August, 2023 (Wednesday).

CADC Emergency Budget Session 2023-24 Concludes

Kamalanagar, June 22, 2023: The CADC Emergency Budget Session for the fiscal year 2023-24 for an amount of Rs. 24,176.24 lakhs which was tabled on June 19 was discussed and passed today by 17 members voting in favour while one member Dg. Nirupam Chakma opposed and walked out of the session and another member Dg. Doymoy Daveng Chakma abstained.

Earlier, the Supplementary Demand for Grants, 2022-23 & Re-appropriation of Local Receipts Fund, 2022-23 were discussed and unanimously passed with all the members voting in favour. The Demand for Grants, 2023-24 which was also discussed and passed with 16 members voting in favour while one member opposed and another abstained from voting.

Dg. Nirupam Chakma speaking expressed that the process of passing of budget in the house is not as per Rule 126 (1) of the CADC (CCB etc.) Rules, 2002 as amended from time to time and Para 13 of the Sixth Schedule to the Constitution of India. He emphasized that the Executive Committee of CADC should pressure the State Government to implement such rule as enshrined in the Sixth Schedule.

Dg. Rasik Mohan Chakma, CEM, CADC and Leader of the House in his reply said that several representations have already been submitted to the State Government as well as the Central Government to implement Para 13 of the Sixth Schedule but to no avail. “The present form of passing of budget in the house has been followed from the beginning”, he added.
